Sales Policy / Kitten Contract
Please read our kitten contract in it's entirety before contacting us about our kittens. This contract MUST be signed in order to adopt a kitten from us, NO EXCEPTIONS. We care very deeply for every kitten born in our home, and we want them to go to the best of homes. We reserve the right to refuse the sale of our kittens without explanation.
In order to reserve a kitten, a 50% NON-REFUNDABLE deposit is required unless other arrangements are made after speaking to us. We do understand that choosing the right kitten for your family is important, and meeting a kitten prior to deposit is not always an option.
We can ship, but prefer to place locally or through ground transit. Transport fees are the responsibility of the buyer, as is any fees accrued getting the cat ready for air transport; ie vet certification, extra vaccinations, airline approved carrier and accessory costs, USDA certification and mail fees, etc. Air transit is available at the Sky Harbor International Airport in Phoenix Arizona, and international flights may be flown from LAX in Los Angeles, CA. Gas and time of ground transport from driving to LAX from Prescott AZ is not included in the purchase price and is the responsibility of the buyer. We would prefer the kitten be picked up in person and flown as a carry on, and because of numerous recent animal deaths on several major airlines, we no longer offer below cabin transit for our cats and kittens. SELLER OBLIGATIONS:
1. The Seller, Soft Paws Haven, will have lovingly raised this kitten with hours of playing, snuggling and petting in a free-roam home environment free of cages, constraints, smoke, or any cruelty. The personality of the cat or kitten will reflect the loving environment they are raised in.
2. Kitten/Cat will be groomed, well-adjusted, happy and healthy at time of purchase.
3. Your Kitten has nursed until it has been weaned and has been drinking filtered water changed daily.
4. Your Kitten has been eating food specifically made by holistic veterinarians specializing in raw diets. Once they stop nursing, we mix organic, home grown rabbit meat with “My Natural Cat” nutritional supplement; a GLUTEN-free (no grain) raw cat food mix. We recommend that this kitten remain on this diet for the rest of his/her life, but if need be, transferred to a freeze dried or frozen raw brand of commercial food, or a high-quality grain free wet or dry cat food. We will provide a few days’ worth of our home-made food for a smooth transition to whatever food you select.
5. Kittens are fed twice daily. If rabbit is not available, they are fed the “My Natural Cat” diet using chicken or turkey. Fish, pork or beef are never used in the raw food diet.
6. The Seller has carefully selected the parentage of your kitten for optimum health, temperament, beauty, and personality. Your kitten will have Grand Champion parentage or bloodlines.
7. The Seller will provide the Buyer with CFA registration/transfer of ownership paperwork upon proof of spay/neuter, if bought before 6 months of age. If bought after a spay/neuter age (6 months), alteration will be provided free of charge.
8. We provide a 72-hour limited health warranty that the above kitten/cat is in good health and is free from upper respiratory infections, intestinal parasites, fleas or mites.
9. The Seller will have completed all of the age-appropriate vaccinations and all health care up until delivery at Seller’s expense, including age appropriate vaccinations against panleukopenia (feline distemper), calicivirus, and rhinotracheitis. A copy of the kitten's health record will be given to the buyer at the time of purchase. At that time, all health care will become the responsibility of the new owner.
10. The Seller also warranties that the kitten is free of the feline leukemia virus (FeLV), and the feline immunodeficiency virus (FIV) at the time of purchase.
11. If the Buyer chooses to inoculate for feline infectious peritonitis (FIP), FeLV or FIV the warranty is invalidated. In addition, the Seller will not warranty the kitten against any adverse reactions to future vaccinations, or any future health problems other than genetic defects.
12. If the kitten described above dies within two years of the date of purchase due to a congenital or hereditary defect, the Seller will replace the cat with a cat or kitten of similar or better quality or a refund of all or part of the purchase price, at the discretion of the Seller. To determine if the cat's death has been caused by a congenital or hereditary defect, the Seller must receive proof of the defect in the form of a complete necropsy report and a complete medical history provided by the attending veterinarian, performed at the Buyer's expense. Only a hereditary of congenital defect that causes death will be cause for a replacement. Accidental deaths and other problems will not be covered. The Seller will make every attempt to replace the cat with a Kitten/Cat of similar or better color, marking, and quality.
13. If this kitten/cat is found to have been neglected by the Buyer, or in ill health for an unreasonable length of time, or if the Buyer does not abide by the terms of this contract, the Purchaser will surrender said kitten/cat to Seller unconditionally.
14. The Seller will give the Buyer the kitten's CFA (Cat Fancier's Association) registration form(s) in a timely manner, or after proof of altering has been submitted to the Seller.
15. The Kitten/Cat's litter will be registered with the CFA. Any additional registrations will be at the option of the Buyer and their responsibility.
BUYER OBLIGATIONS:
1. In order to validate this warranty, the Buyer must take the kitten to a veterinarian within 72 hours, at the Buyer's expense. The Buyer must notify the Seller of any claim under the warranty immediately. Any necessary treatment or other expenses are the responsibility of the Buyer. All health-related decisions and expenses are the responsibility of the owning party.
2. If the veterinarian finds any physical problems that make the veterinarian think the kitten is a poor health risk, the veterinarian should write and sign a note on his/her letterhead stationery, explaining his/her findings within the first 72 hours.
3. If the above conditions are made, the kitten may be returned to the Seller within seven days for a refund minus the deposit, or exchanged for a new kitten, if available. The Buyer will be responsible for any shipping and handling costs. The Seller will make every attempt to replace the kitten with a kitten of the same gender, color, and markings, of similar or better quality.
4. The Buyer agrees to provide the cat with a clean, pleasant environment, conducive to good health and with adequate space for exercise. At least one litter box will be provided for each cat in the household and will be cleaned daily. The cat will be kept un-caged for the main duration of its life.
5. The Buyer will provide the cat with proper nutrition in the form of food that is healthful and balanced for a feline.
6. Fresh water will be provided daily.
7. The Buyer will provide the cat with proper veterinarian care, vaccines, and companionship. Any significant health conditions during the cat's lifetime will be reported to the Seller.
8. The buyer will take into consideration the Abyssinian cat's unique need for companionship and not leave the cat alone for long periods of time without companionship and care.
9. The Buyer will not let the cat roam outdoors. Letting the kitten/cat roam outdoors puts this kitten in jeopardy of animal attack, theft, injury by automobile or of coming in contact with sick animals, and is a violation of this contract, thereby voiding the warranty.
10. The Buyer will not declaw the kitten/cat. De-clawing is a serious surgery/amputation that removes the top knuckle on the paws of the kitten/cat called a tendonectomy procedure and is in violation of this contract, and will void the warranty.
11. The Buyer is not allowed to reproduce this cat (by breeding, cloning, etc.) without written consent from the Seller. If this is a Breeder, you will have the Breeder Contract and the Breeder Rights Addendum.
12. A scratching post and regular claw trimming will be provided for this Kitten/Cat.
13. The Buyer will not, under any circumstances, give, sell, or lease the kitten/cat to any animal shelter, research facility or lab, kitten mill, laboratory, pet store, or other commercial enterprise. Because we love these kittens, if we find out any of our cats have ended up in shelters, we will sue in civil court for the full cost to Buyer of the pet, plus all legal fees, any distress to cat or Soft Paws Haven, and any additional costs to rehabilitate the Kitten/Cat.
14. In the event that the Buyer can no longer keep the kitten/cat, the Seller will be contacted with first rights to the kitten/cat or to assist in the placement of the animal.
15. If the Buyer can no longer care for the kitten or wishes to give up the kitten for any reason, the Buyer must first notify the Seller. If the Seller decides to buy back the cat, the price will be negotiated at that time, but will not exceed half of the cats purchase price.
16. Abyssinians are extremely sensitive cats and often experience a period of adjustment that is aggravated by changes in environment and/or the addition or introduction of other felines. In these situations, owners need to be sensitive to signs of stress and make sure weight is maintained. New Kitten/Cats often show physical signs of stress within the first two weeks in a new home including but not limited to: sneezing, runny nose, watery eyes, diarrhea, constipation, or hair loss. If any of these symptoms persist for longer than 72 hours after undivided attention has been given, please seek a licensed veterinarian care for peace of mind. Kitten/Cats often hide in their new homes for the first 72 hours. Please keep water, food, and a litter box nearby until your kitten/cat acclimates.
17. Buyer agrees to isolate any other cats from this new Kitten/Cat for a minimum of two weeks, and until the veterinarian report finding has shown a clean bill of health for all indoor animals residing in the same home. Cat viruses are highly infectious, so families already containing cats needs to have EVERY cat checked at the vet before the new Kitten/Cat is integrated, or no replacement kitten, or returns will be considered. No exceptions.
18. The New Kitten/Cat should be kept in a small area with limited and supervised exploration of the home for the first week. Unlike humans, cats find small spaces comforting when faced with new situations. We have found that keeping the kitten/cat in the bedroom with you, or in the bathroom next to your bedroom, has offered the most comfort in the first weeks. Keep the kitten’s carrier, food, water, and litter in this smaller space until acclimation has occurred.
19. This kitten/cat is sold as a pet with the understanding that it will not be used for breeding purposes. Any kitten/cat that is used as a breeding cat will be reclaimed by us in civil court for the full cost to the Buyer of the pet, plus all legal fees, and any additional costs to rehabilitate the Kitten/Cat.
20. IF this kitten/cat was purchased whole, it is agreed that the kitten will be altered before the age of 8 months (adults within one month), with proof of altering sent to the Seller. The kitten must be neutered/spayed between 4 and 8 months of age, with 5 to 6 months being ideal. We have found that early spay/neuter (which is properly referred to as after four months) causes the least amount of stress to Abyssinains.
20a. Upon receipt of a licensed veterinarian's written certification, showing that an altering operation has been performed, the above kitten's pedigree and registration application/papers will be forwarded if requested in a timely fashion, and hopefully within 45 days of receipt.
20b. If no altering papers are provided the registration papers will be held on this kitten indefinitely and CFA will be notified of an unauthorized assumed intent to breed this kitten.
21. Buyer agrees to send the Seller via email an electronic picture and email with status update at one year from time of purchase.
LONG-TERM HEALTH CARE AND/OR LEGAL PROCEEDINGS:
1. The Seller will not be held liable for any veterinary or health care costs occurring while the cat is in possession of the Buyer, except as provided for by the above limited warranty.
2. The Seller's maximum liability to the Buyer for any and all losses, claims, damages, or liability of any kind shall be limited to the amount paid by the Buyer to the Seller under this agreement. Any expenses for health care requested of the Seller by the Buyer will be paid at the discretion of the Seller. If Buyer fails to comply with any aspect of this agreement, the Buyer forfeits any rights the Buyer may otherwise have.
3. If legal proceedings become necessary, the Buyer agrees that all legal and/or court procedures take place in the county in which the Seller resides.
This contract establishes the overall terms and conditions applicable for the purchase of an Abyssinian Kitten/Cat from Soft Paws Haven. All terms and conditions remain in effect for the life of the pet, and any agreed upon changes only affect the modified portion of this agreement, and all other terms and agreements remain intact and in effect. Any changes require an addendum with both the Buyer and Sellers signature and date.
By signing below, the parties of the Buyer and the Seller indicate that they have read, agree to adhere to the conditions stated herein, and are in full agreement with all of the above provisions and conditions of the above contract.
